Elon Musk has lost his offer to block Sam Altman to turn the opening into a lucrative entity-but a federal judge signaled Tuesday that it could accelerate a trial to consider other elements of its antitrust case against the creator of the chat.
US District Judge Yvonne Gonzalez Rogers said Musk and his plaintiffs “had failed to fulfill their proof burden for the extraordinary relief” after claiming they faced irreparable harm if Openni to complete a planned restructuring.
“Given the public interest in question and the potential for harm if a conversion has occurred in violation of the law, the court is ready to accelerate the trial until the fall of 2025,” Rogers wrote in its decision.
Last year, Musk’s lawsuit named Openai, Altman, Investor Microsoft, billionaire Reid Hoffman and others as co-defendants.
His lawsuit claims that Openai violated the antitrust law and abandoned his original intention to develop it to benefit humanity as he transformed from a “charity exempt from taxes in a $ 157 billion market.
During the hearing last month, the judge said Musk’s claims for irreparable harm were a “stretch”, but expressed openings for a trial as long as the billionaire took the stance to testify.
“We look forward to a jury to confirm that Highman accepted Musk’s charity contributions knowing well that they should be used to benefit the public than its enrichment,” Musk Teroberoff’s lawyer said in a state decision.
Musk co-founded Openai throughout Altman in 2015 and served as his main investor, pouring about $ 45 million in the beginning for a three-year space.
He later left the firm after disputes over its long -term direction.
Musk has found since an onset of artificial intelligence, Xai, which competes directly with Open.
Public fraud between the two billionaires escalated last month after Musk made a $ 97.4 billion unwanted to obtain Openai’s control.
The offer was quickly rejected by Altman, who repeated his accusation that Musk was simply trying to slow down his main rival.
The judge said Musk’s offer “undermined” his claim for irreparable harm.
“This has always been about the competition,” Openai said in a state with the judge’s decision. “ELON’s emails say he wanted to unite a lucrative operanai in Tesla. This would be great for his personal benefit, but not for our mission or US interests. “
Spat between Musk and Altman has returned personal in recent months while two billionaires trade barbs in the media.
Altman recently told Bloomberg that “whole life is from a position of insecurity” and that he does not think Musk is a “happy person”.
“He is definitely a competitor,” Altman added. “I wish he would just compete by building a better product, but I think there were a lot of tactics, a lot, a lot of lawsuits, all kinds of other crazy items, now that.”
Musk is referred to Altman as a “deceiver”.
